Failing to provide a specific Certificate of Coverage or not registering correctly leads to immediate denial.

"Touristic" Intent

Applying while in an irregular situation or failing to prove the "remote" nature of the contract.

Incorrect Translations

Using standard translations instead of Sworn Translations invalidates the documents.

Frequently Asked Questions regarding the Nomad Visa

Common questions answered by our Spain Digital Nomad Visa Lawyers regarding taxes and bureaucracy.

Who is eligible to apply for this Visa?

It is designed for non-EU/EEA citizens. You must be employed by a non-Spanish company or be a self-employed freelancer with global clients. The key requirement is that your work can be performed 100% remotely using telecommunication systems.

Can I apply from Spain while on a Tourist Visa?

Yes, and it is highly recommended. If you apply legally from Spain (during your 90-day tourist stay), you apply directly to the UGE under the "Law 14/2013". This grants you a 3-year residency permit immediately, skipping the 1-year visa step required when applying from a Consulate in your home country.

Will I become a tax resident in Spain?

Yes. Spending more than 183 days in Spain triggers tax residency. However, Digital Nomads are eligible for the special "Beckham Law" regime. This allows you to pay a flat tax rate of 24% on income up to €600,000 for up to 6 years, avoiding the progressive tax scale (which can go up to 47%).

Can I travel freely within Europe?

Absolutely. The Digital Nomad residency acts as a valid Schengen residence permit. You can travel visa-free to any country in the Schengen Area (France, Italy, Germany, etc.) for up to 90 days within any 180-day period.

Can I work for Spanish clients?

Yes, but with limitations. You are allowed to invoice Spanish companies as long as that income does not exceed 20% of your total professional income. The remaining 80% must originate from outside of Spain.

Can I bring my spouse and children?

Yes. The Main Applicant can include their legal spouse (or unmarried partner with proof of relationship) and dependent children. You must demonstrate additional financial means: +75% of the SMI for the first relative and +25% for each additional one.
